    Terms of Service

    Last updated: April 20, 2026

    1. Acceptance and eligibility

By creating an account or purchasing access to Brainer, you agree to these Terms and our Privacy Policy. You must be at least 16 years old. If you're using Brainer on behalf of a business, you represent that you have authority to bind that business.

    2. The product

Brainer is a web application that helps you build a "Brand Brain" — a structured set of voice, brand, and content assets you can plug into AI tools like ChatGPT and Claude. Access is sold on a one-time, lifetime basis (defined below).

    3. Your account

You're responsible for keeping your login credentials safe and for all activity under your account. One account per person — accounts are not transferable. Notify us immediately at hello@thelfactor.co if you suspect unauthorized access.

    4. Payment

Lifetime access to Brainer is $49 USD (or the promotional price displayed at checkout), one-time. Payment is processed through Stripe. Applicable taxes may be added based on your location. Promotional pricing is honored at the rate displayed when you purchase.

    5. Refund policy

All sales are final. We do not offer refunds.

Because you get immediate, full access to a digital product the moment you purchase, we don't issue refunds for any reason — including change of mind, lack of use, or dissatisfaction with results. Please review the sales page, FAQ, and free Brand Voice Generator before purchasing to make sure Brainer is right for you.

If something is genuinely broken or you can't access what you paid for, email hello@thelfactor.co and we'll fix it.

    6. License and intellectual property

What you own: Everything you create or paste into Brainer — your Brand Brain content, voice samples, generated outputs — belongs to you. You can use it commercially without restriction.

What we own: The Brainer platform, the underlying methodology, our prompts, our templates, our designs, and our code. We grant you a personal, non-exclusive, non-transferable license to use Brainer for your business.

You may not resell, sublicense, or repackage Brainer's prompts, templates, or methodology as your own product.

    7. Acceptable use

    You agree not to:

    • Use Brainer to generate illegal, harmful, hateful, harassing, or deceptive content
    • Scrape, copy, or attempt to extract our prompts, templates, or proprietary methodology
    • Resell access to your account or share login credentials
    • Use automated tools to abuse the AI features or generate excessive load
    • Reverse engineer or attempt to bypass paywalls or access controls
    • Submit content you don't have the right to use

    8. AI output disclaimer

Brainer's outputs are generated by AI models. You are responsible for reviewing every output before publishing or using it. AI can be inaccurate, biased, or produce content that doesn't fit your situation. We make no warranty that outputs will be accurate, useful, or fit for any particular purpose. Use your judgment.

    9. Service availability ("lifetime" access)

"Lifetime" means the lifetime of the product. We intend to operate Brainer indefinitely, but we can't guarantee it forever. If we discontinue the product, we'll give you at least 60 days' notice and a window to export your Brand Brain content. We may also pause access for maintenance, updates, or to address security issues.

    10. Termination

You can delete your account at any time via the user menu. We can suspend or terminate accounts that violate these Terms, abuse the service, or engage in fraud. If we terminate for cause, no refund is owed.

    11. Warranty disclaimer

Brainer is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement. We don't warrant the service will be uninterrupted, error-free, or meet your specific needs.

    12. Limitation of liability

To the maximum extent permitted by law, our total liability to you for any claim related to Brainer is capped at the amount you actually paid us in the 12 months before the claim arose. We are not liable for indirect, incidental, consequential, special, or punitive damages — including lost profits, lost data, or business interruption.

    13. Indemnification

You agree to indemnify and hold harmless The Luminaire Factor LLC from any claim arising out of your use of Brainer, your violation of these Terms, or your violation of any third party's rights (including content you submit or publish using Brainer outputs).

    14. Changes to these Terms

We may update these Terms from time to time. Material changes will be announced via email or in-app notice. Continued use after the change means you accept the new Terms.

    15. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Delaware, and you consent to that jurisdiction.
